Effective October 1, 2025, The National Institutes of Health (NIH) has updated the Terms and Conditions of Award for all new, renewal, supplement, and continuation Notices of Award. The revised language reinforces federal requirements for award termination and clarifies how NIH will apply terms that become subject to court orders.
All new Notices of Award will now include updated termination language aligned with 2 CFR 200.340. By accepting an NIH award, recipients agree that continued funding is contingent on the availability of appropriated funds, satisfactory performance, and compliance with all Terms and Conditions of the award. NIH may also terminate an award, as authorized by law, when it determines the award no longer supports program goals or agency priorities.
The updated terms also address situations in which NIH is legally enjoined from imposing or enforcing a specific condition. Any term or condition affected by a court order will not apply to the recipients or subrecipients covered by that order for the duration of the injunction.
In addition, new Notices of Award will reference 2 CFR 200 instead of 45 CFR Part 75, where applicable. All changes will apply prospectively to awards issued on or after October 1, 2025, and the revised language will be incorporated into the FY26 NIH Grants Policy Statement.
